Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and the Abia State Technological Skills Acquisition Centre ("ATSAC"), a government initiative of the Abia State Government, Federal Republic of Nigeria.

By accessing or using any ATSAC website, web application, mobile application, digital platform, portal, form, database, directory, service, programme, or any related digital property (collectively, the "Platform"), you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Platform.

These Terms apply to all users of the Platform, including but not limited to: prospective trainees, applicants, programme participants, service providers, service requesters, talent directory registrants, corporate partners, individual partners, mentors, mentor applicants, community members, visitors, and any person who submits any form or request through the Platform.

The ATSAC Platform encompasses a range of digital services and features, including but not limited to:

• Skills acquisition programme admissions and application portals;
• Talent and professional directory for trained individuals and organisations;
• Service booking and certificate verification tools;
• Community membership registration and management;
• Mentor application and matching systems;
• Innovation centre booking and scheduling;
• Partnership and sponsorship enquiry systems;
• Prepaid meter installation programme applications;
• Publication, news, media, and information repositories;
• Contact and general enquiry forms;
• Any other digital service now or hereafter offered by ATSAC.

These Terms govern all of the above, individually and collectively, regardless of which specific feature or form a user engages with.

ATSAC makes no representation, warranty, or guarantee — express or implied — that participation in any programme, training, or initiative will result in employment, income, career advancement, business success, certification recognition by any third party, or any other particular outcome.

Programme listings, curricula, schedules, instructors, facilities, and outcomes described on the Platform are subject to change at any time without prior notice. ATSAC does not guarantee the availability, continuity, or quality of any programme, service, or initiative featured on the Platform.

The issuance of any certificate, badge, or credential by ATSAC does not constitute a professional licence, regulatory certification, or any form of guarantee of skill, competence, or fitness for any particular purpose. All credentials issued reflect participation in designated training as at the time of issuance only.

TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, THE ABIA STATE GOVERNMENT, ATSAC, THEIR MINISTRIES, DEPARTMENTS, AGENCIES, OFFICIALS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, AND SUCCESSORS (COLLECTIVELY "ATSAC PARTIES") SHALL NOT BE LIABLE TO ANY USER OR THIRD PARTY FOR ANY CLAIM, DEMAND, LOSS, DAMAGE, COST, OR EXPENSE OF ANY NATURE WHATSOEVER — WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY — ARISING FROM OR IN CONNECTION WITH:

• Access to, use of, inability to use, or reliance on the Platform or any part thereof;
• Any information, content, data, or material provided on or through the Platform;
• Any form submitted through the Platform, including applications, enquiries, registrations, or requests;
• Any decision made by ATSAC or its personnel regarding applications, admissions, shortlisting, or selection;
• Non-selection, rejection, or failure to receive any response to any submission;
• Any programme, training, workshop, mentorship, or initiative offered or facilitated by ATSAC;
• The conduct, acts, omissions, negligence, fraud, or misconduct of any service provider, mentor, partner, community member, or third party listed or connected through the Platform;
• Any engagement, agreement, contract, or transaction between users and third parties identified through the Platform;
• Financial loss, property damage, personal injury, loss of life, or any other harm arising from services sought or rendered by any party found through the Platform;
• Any data breach, unauthorised access, loss, corruption, or destruction of personal data;
• Any technical failure, downtime, error, bug, virus, or malfunction of the Platform;
• Any inaccuracy, incompleteness, or outdated nature of any information on the Platform;
• Any misrepresentation made by any user, applicant, service provider, or partner on the Platform;
• Any failure to fulfil any commitment, promise, or representation made verbally or in writing by any ATSAC personnel outside of these Terms.

This exclusion of liability applies irrespective of the legal theory upon which a claim is based — whether in contract, tort, negligence, strict liability, statute, equity, or otherwise — and regardless of whether ATSAC has been advised of the possibility of such loss or damage.

Where applicable law does not permit the complete exclusion of certain types of liability, ATSAC's liability shall be limited to the minimum extent required by law.

Any information or data voluntarily submitted by a user through any form on the Platform — including personal details, biographical information, professional credentials, programme applications, service requests, community registration forms, partnership proposals, or any other submission — is provided entirely at the user's own risk.

ATSAC does not accept any liability for:

• Any errors, inaccuracies, or omissions in submitted information;
• Any consequence arising from the use, review, storage, processing, or sharing of submitted data;
• Any decision (including adverse decisions) made on the basis of submitted information;
• Any technical failure resulting in loss, corruption, or non-receipt of submitted data;
• Any reliance by a third party on information submitted by a user.

Submission of any form on the Platform does not create any contractual obligation, legal entitlement, or expectation of response on the part of ATSAC or the Abia State Government. ATSAC reserves the right to disregard, reject, delete, or act upon any submission at its sole discretion, without explanation or recourse.

By using the Platform, you represent and warrant that:

• All information you submit is truthful, accurate, and not misleading;
• You are at least 18 years of age or are accessing the Platform with the consent of a guardian;
• You will not use the Platform for any unlawful, harmful, abusive, fraudulent, or deceptive purpose;
• You will not interfere with, disrupt, or compromise the security or functionality of the Platform;
• You will conduct your own independent due diligence before engaging with any service provider, mentor, partner, or community member identified through the Platform;
• You understand that any engagement with third parties found through the Platform is entirely your own responsibility and is at your own risk;
• You will not attempt to impersonate ATSAC, any government official, or any other user.

ATSAC reserves the right to suspend, remove, or permanently ban any user from the Platform for violation of these Terms, without notice and without liability.

Nothing in these Terms or on the Platform creates or implies any employment, agency, partnership, joint venture, franchise, or representative relationship between ATSAC, the Abia State Government, and any user, service provider, community member, mentor, partner, or any other party.

Service providers, mentors, community members, and any third parties listed or connected through the Platform are entirely independent individuals or entities acting on their own behalf. ATSAC does not direct, supervise, endorse, or take responsibility for the activities, representations, or conduct of any such parties.

All content on the Platform — including but not limited to text, graphics, logos, images, audio, video, data compilations, programme materials, and software — is the property of ATSAC, the Abia State Government, or their licensors, and is protected under applicable intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for its intended purposes only. No content may be reproduced, distributed, publicly displayed, or used for commercial purposes without the prior written consent of ATSAC.

The Platform may contain links to third-party websites, social media platforms, WhatsApp groups, or external services. ATSAC has no control over, and accepts no responsibility for, the content, policies, or practices of any third-party services. Links are provided for convenience only and do not constitute endorsement.

Your interactions with third-party services, including any platforms you join as a result of links provided on the ATSAC Platform, are governed entirely by the terms and policies of those third parties. ATSAC shall not be liable for any harm or loss arising from your engagement with any third-party service.

ATSAC endeavours to provide accurate and current information on the Platform but does not warrant, represent, or guarantee the completeness, accuracy, reliability, suitability, or availability of any information, content, product, or service on the Platform. All information is provided on an "as is" and "as available" basis without warranty of any kind.

Information regarding programme fees, dates, eligibility criteria, application deadlines, and availability is subject to change without notice. Users are advised to contact ATSAC directly to confirm current programme details before making any decisions.

You agree to defend, indemnify, and hold harmless the ATSAC Parties (as defined in Section 4) from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including legal fees) arising from:

• Your use of the Platform;
• Any information or content you submit to or through the Platform;
• Your violation of these Terms;
• Your violation of any applicable law, regulation, or third-party right;
• Any claim brought by a third party arising from your conduct on or through the Platform.

Any dispute between a user and a third party identified through the Platform is entirely a matter between those parties. ATSAC will not mediate, arbitrate, adjudicate, or intervene in any such dispute and shall not be joined as a party to any proceedings arising from such disputes.

Any claim a user believes they may have against ATSAC must first be submitted in writing to ATSAC for internal review. ATSAC retains absolute discretion to accept or reject such claims. Nothing in this provision creates any obligation on ATSAC to resolve, compensate, or respond to any such claim.

ATSAC reserves the right to amend, revise, or replace these Terms of Service at any time, with or without prior notice. The date of the most recent revision will be displayed at the top of this page. Your continued use of the Platform following the posting of any changes constitutes your acceptance of the revised Terms. It is your sole responsibility to review these Terms regularly.

ATSAC reserves the right to modify, suspend, restrict, or permanently discontinue any part of the Platform at any time, without notice and without liability. ATSAC does not guarantee uninterrupted, error-free, or secure access to the Platform at any time.

These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any legal proceedings relating to these Terms or the use of the Platform shall be brought exclusively in the courts of competent jurisdiction in Abia State, Nigeria, and you irrevocably submit to the jurisdiction of such courts.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of the Terms, which shall continue in full force and effect.

These Terms of Service, together with the ATSAC Privacy Policy, constitute the entire agreement between you and ATSAC regarding your use of the Platform and supersede all prior or contemporaneous agreements, representations, warranties, or understandings, whether oral or written.
